The legal answer to this question is yes. Even if you're not intending to drive, you can get slapped with a DUI. In the majority of states, it's against the law to be in physical control of a car while you're under the influence.
Unlike some of our neighboring states, there is no “public way” requirement for DUI. In Massachusetts, the prosecution is required to prove that the motorist was operating on a “public way” which has a specific definition and clearly does not include private property.
