No other business in the Shipshewana town limits sells alcoholic beverages. It isn't offered at the town's fine restaurants and eateries. It is allowed for catering purposes, but that's about it. Recently, Gas America decided it wanted to offer beer and wine for purchase at its Shipshewana store.
Indiana is the only state that restricts the sale of cold beer. The plaintiffs are citing a 2012 federal ruling that Kentucky's laws prohibiting liquor and wine sales in groceries, quick stores and gas stations violated the Equal Protection Clause of the U.S. Constitution. That law is still in effect pending an appeal.
